Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of the websites, web application, and related services offered by Dreamora (“Dreamora,” “we,” “us,” or “our”) (collectively, the “Service”).

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility and parent use

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a family, you represent that you are the parent or legal guardian (or have appropriate authorization) for any child-related information you provide.

The Service is designed for adults to operate on behalf of children. You are responsible for supervising any child’s participation in story reading or listening.

Description of the Service

Dreamora helps you generate and read interactive bedtime-style stories. Features may change as we improve the product. The Service is offered on a web basis today; native mobile applications may be offered separately in the future, in which case additional store-specific terms may apply when you download or purchase through those channels.

We may use experimental or beta features from time to time. Those features are provided as-is and may be modified or withdrawn.

AI-generated content and your review

Story content may be created using artificial intelligence and similar technologies. AI outputs can be wrong, inconsistent, or inappropriate for your family. You are solely responsible for reviewing content before sharing it with a child and for deciding whether it is suitable.

Dreamora does not provide medical, psychological, legal, or other professional advice. Do not rely on the Service as a substitute for professional judgment where it matters.

Acceptable use

You agree not to:

  • Use the Service in violation of law or the rights of others.
  • Attempt to probe, scan, or test the vulnerability of our systems, or breach security or authentication measures.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use the Service to generate or distribute content that is unlawful, exploitative, hateful, harassing, or sexual involving minors.
  • Reverse engineer, decompile, or attempt to extract source code or models except where applicable law prohibits this restriction.
  • Use automated means to access the Service in a way that places unreasonable load on our infrastructure or circumvents rate limits.

Accounts and device identifiers

The Service may associate your activity with a device identifier, an account, or both. You are responsible for maintaining the confidentiality of any credentials and for activity under your account. Notify us promptly if you suspect unauthorized access.

Fees, trials, and subscriptions

Some features may be free, offered as a trial, or available only with a paid subscription. When paid plans are available, pricing and billing terms will be presented at purchase (for example, on our website checkout or within a mobile app listing). Until you complete a purchase through a disclosed flow, you have not entered into a paid subscription with us.

If we launch subscriptions through the Apple App Store or Google Play, those purchases will be processed by the applicable platform, and platform terms and policies will also apply. We do not represent here that in-app purchase is available until it is offered in the product.

Unless stated otherwise at checkout, subscriptions renew until canceled. You are responsible for canceling through the channel where you purchased (for example, your app store account settings).

We may change prices or plans with reasonable notice where required by law or contract.

Intellectual property

The Service, including its software, branding, and non-user content, is owned by Dreamora or our licensors and is protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial family use.

You retain rights in content you submit. To operate the Service, you grant Dreamora a worldwide, non-exclusive license to host, process, transmit, and display your submissions solely to provide and improve the Service, comply with law, and enforce these Terms. Use of content for model training or similar purposes, if any, is described in our Privacy Policy and may require additional notice or consent where applicable law requires.

Third-party services

The Service may link to or rely on third-party services (including AI providers, hosting, and analytics). Those services are governed by their own terms and policies. We are not responsible for third-party services we do not control.

Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREAMORA AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR USE OF THE SERVICE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) FIFTY U.S. DOLLARS (US$50), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATION.

Some jurisdictions do not allow certain limitations; in those cases, our liability will be limited to the fullest extent permitted by applicable law.

Indemnity

You will defend, indemnify, and hold harmless Dreamora and its affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Service, your content, your violation of these Terms, or your violation of others’ rights.

Termination

You may stop using the Service at any time. We may suspend or terminate access to the Service if you violate these Terms, if we are required to do so by law, or if we discontinue the Service (with reasonable notice where practicable).

Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive termination.

Governing law; disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules, except that U.S. federal law may apply where required.

Subject to applicable law, you and Dreamora agree that exclusive jurisdiction for disputes relating to these Terms or the Service will be the state and federal courts located in Delaware, USA, and you consent to personal jurisdiction there.

If you are a consumer, you may have rights to bring disputes in your local jurisdiction where required by law; nothing in this section limits those non-waivable rights.

General

These Terms constitute the entire agreement between you and Dreamora regarding the Service and supersede prior agreements on the subject. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

Changes to these Terms

We may modify these Terms from time to time. We will post the updated Terms on this page and update the “Last updated” date. If a change is material, we will provide additional notice as appropriate. Continued use after the effective date of changes constitutes acceptance unless applicable law requires a different process.
